Terms of Use

These terms are an agreement between you and the independent developer of eCue ("we", "us") covering your use of the eCue iPhone app. By using the app you accept them. If you do not agree with them, please do not use the app.
eCue is not therapy or medical advice
Please read this part. eCue is an educational practice tool. It is not therapy, counselling, diagnosis or medical, psychological or clinical advice, and it is not a substitute for care from a qualified professional. Do not rely on it to make decisions about your health or wellbeing, and never delay seeking professional help because of something you read here.
If you are in distress or in crisis, please contact a qualified professional or your local emergency services. eCue cannot help in an emergency and does not monitor anything you write.
Social situations vary enormously between people, relationships and cultures. eCue ranks possible responses by how well they fit the information in an example scenario. It does not tell you what is correct, and following any suggestion is your own decision and responsibility.
Using the app
We grant you a personal, non-exclusive, non-transferable, revocable licence to use eCue on Apple devices you own or control, as permitted by the App Store Terms of Service. You agree not to copy, sell, rent, sublicense, reverse engineer or attempt to extract the source code or lesson content of the app, except where the law expressly allows it.
All content in eCue, including lesson text, scenarios, artwork and the Otto character, belongs to us and is protected by copyright. Using the app does not transfer any ownership to you.
Subscriptions
Parts of eCue may require a paid subscription. If you buy one:
- Payment is charged to your Apple Account when you confirm the purchase.
- The subscription renews automatically for the same period at the same price unless you cancel it at least 24 hours before the current period ends.
- Your Apple Account is charged for renewal within 24 hours before the current period ends.
- You can manage or cancel the subscription in the Subscriptions section of your Apple Account settings. Deleting the app does not cancel it.
- Prices are shown in the app before you confirm, and may vary by region and change over time.
All purchases are handled by Apple. Refunds are Apple's to grant under the App Store terms, not ours, so please request them through Apple. We can still help with anything else at hello@ecueapp.com.
Your content
Anything you write in a reflection prompt stays on your device. We never receive it, so we claim no rights over it and cannot recover it if you delete the app or lose your device.
Availability and changes
We may update, change or discontinue the app or any part of its content at any time. We try to keep it working well, but we do not promise it will always be available, uninterrupted or free of errors.
Disclaimer and limits
To the fullest extent the law allows, eCue is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
To the fullest extent the law allows, we will not be liable for indirect, incidental, special, consequential or punitive damages, or for any loss of data, arising from your use of the app. Where liability cannot be excluded, it is limited to the amount you paid for eCue in the twelve months before the claim.
Some jurisdictions do not allow certain warranty exclusions or liability limits, so parts of this section may not apply to you. Nothing here removes rights you have as a consumer that cannot legally be waived.
Apple
Apple is not a party to these terms and is not responsible for eCue or its content. Apple has no obligation to provide support for the app. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
Ending these terms
You may stop using eCue at any time by deleting it. We may end your licence if you breach these terms. The sections on disclaimers, liability and governing law survive.
Governing law
These terms are governed by the laws of the State of Texas and the United States, without regard to conflict of law rules. Disputes will be handled by the courts located in Texas, unless consumer protection law in your own country or state gives you the right to bring a claim where you live.
Changes to these terms
If we change these terms we will update this page and the date at the top. Continuing to use the app after a change means you accept the updated terms.
